Terms of Service

1. The service

RelistNow provides an AI-powered tool that helps you create listings for secondhand goods on resale platforms including Poshmark, eBay, Depop, Etsy, and Facebook Marketplace. We offer free and paid subscription plans.

2. Your account

• You must be 18 or older (or the age of majority in your jurisdiction) to create an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You may not share your account with others on plans that include a single seat
• One person may not operate multiple free accounts to circumvent usage limits

3. Acceptable use

You agree to use RelistNow only for lawful purposes. You may not:

• Use the service to create listings for counterfeit, stolen, or prohibited items
• Attempt to reverse engineer, scrape, or extract data from the service programmatically (unless you have an API plan)
• Use the service in a way that could damage, disable, or impair our servers or networks
• Attempt to bypass usage limits, authentication, or access controls
• Use the service to generate content that is misleading, fraudulent, or violates platform rules on any resale marketplace
• Resell or sublicense access to the service without our written permission

You are responsible for ensuring that items you list comply with the terms and policies of each resale platform you post to.

4. AI-generated content

RelistNow uses AI to generate item descriptions, pricing suggestions, and listing content. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or hallucinations
• You are responsible for reviewing and verifying all AI-generated content before posting listings
• Pricing suggestions are estimates based on market data and are not guarantees of actual sale prices
• We are not responsible for losses arising from reliance on AI-generated pricing or identification

5. Subscription and billing

• Paid plans are billed monthly or annually in advance via Stripe
• You may upgrade or downgrade your plan at any time
• Upgrades take effect immediately. Downgrades take effect at the end of your current billing period
• Annual plans are charged upfront for 10 months of service (equivalent to 12 months)
• We do not offer refunds for partial months on monthly plans
• Annual plan refunds are prorated and available within 14 days of purchase if you have not exceeded 10 analyses
• We reserve the right to change pricing with 30 days notice to existing subscribers

6. Free tier

The free tier provides 7 AI analyses per month and access to Poshmark listing generation only. Free tier usage limits reset on the first day of each calendar month. We reserve the right to modify free tier limits at any time with reasonable notice.

7. eBay integration

When you connect your eBay account, you authorize RelistNow to create listings on your behalf using eBay's API. You remain responsible for all listings created through the service. RelistNow is not affiliated with or endorsed by eBay. eBay's terms of service apply to all listings you create, whether through RelistNow or directly.

8. Your content and data

You retain ownership of all photos, item data, and inventory records you create in RelistNow. By uploading photos, you grant us a limited license to process them for AI analysis. We do not claim ownership of your content. See our Privacy Policy for details on how we handle your data.

9. Intellectual property

The RelistNow name, logo, interface, and underlying software are owned by RelistNow and protected by intellectual property laws. You may not copy, reproduce, or create derivative works from our interface or software.

10. Disclaimers

RelistNow is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that AI-generated content will be accurate. We are not responsible for the actions of third-party resale platforms.

11. Limitation of liability

To the maximum extent permitted by law, RelistNow's total liability for any claim arising from use of the service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or lost sales.

12. Termination

We may suspend or terminate your account if you violate these terms. You may cancel your account at any time from your profile settings. Upon termination, your data is retained for 90 days and then permanently deleted, as described in our Privacy Policy.

13. Changes to terms

We may update these terms. We will notify you via email or in-app notice for material changes. Continued use after the effective date constitutes acceptance of the updated terms.

14. Governing law

These terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law principles.
